CT Elderly Defendant's Carrier Tenders Full Auto Policy Limit

A $50,000.00 settlement was procured from the Hartford Insurance Company paid on behalf of a Woodbury defendant. The New Milford, Connecticut plaintiff was a mason by trade. He was traveling on Woodbury Road in Watertown, Connecticut when he was cut off by an elderly defendant making a left hand turn.

The plaintiff suffered low back pain, radiating leg pain, a herniated disc at the L5-S1, headaches and neck pain. The plaintiff carried no health insurance and only had $1,000.00 of auto medical pay. The Rotatori Law Firm was able to secure him significant pain management care which included an examination by a neurosurgeon, nerve blocks and radiofrequency nerve ablation by a pain management physician. He was assigned a ten percent permanent partial impairment of the low back.

Attorney Peter Rotatori, III was able to recover the defendant's full automobile policy limit. The plaintiff did not have underinsured motorist coverage available to him as his um coverage was less than the coverage carried by the defendant owner/operator. An asset search revealed that the elderly defendant driver had limited assets and his home was in foreclosure. Our law firm advises all automobile owners and operators to carry high limits of uninsured/underinsured motorist coverage!
