The plaintiff, a Watertown, Connecticut resident, was a passenger in a motor vehicle operated by her son on Park Road in Waterbury, Connecticut. The defendant attempted to leave the parking lot of "The Hills" restaurant and drove into the plaintiff's proper lane of travel striking the automobile that the plaintiff passenger was in head on.
The defendant was intoxicated with BAC test results which were twice the legal limit. The defendant flunked the field sobriety tests administered by the investigating police officer.
The plaintiff sustained neck strain, mid back strain and low back strain. She had a significant history of preexisting chiropractic care. The plaintiff's accident related health care consisted of both chiropractic care and physical therapy.
Suit was filed in the Waterbury Superior Court. Prior to suit the carrier had offered $23,000.00 to fully and finally resolve the claim.
